Miss Gay AmericaÂŽ Official Program Advertising Standards & Terms and Conditions

Official Program Advertising Policy

The Miss Gay AmericaÂŽ Official Program is intended to present a professional, consistent, and prestigious publication that reflects the history, excellence, and integrity of Miss Gay America Pageantry. To preserve the visual identity of the organization, all advertising submitted for publication shall comply with the following standards and conditions.

Submission of advertising constitutes acknowledgment and acceptance of these Terms and Conditions.


1. Artificial Intelligence (AI) Generated Content

To preserve the authenticity of the Miss Gay AmericaÂŽ brand and its titleholders, AI-generated imagery shall not be used to create, replace, manipulate, or substantially alter official advertising featuring Miss Gay America titleholders, contestants, crowns, official regalia, or official pageantry imagery.

The following are prohibited:

  • AI-generated portraits or likenesses of titleholders or contestants.
  • AI replacement or recreation of photography.
  • AI manipulation that materially alters official photographs.
  • AI-generated backgrounds or visual elements that diminish or overwhelm the official subject.
  • AI-generated ad copy intended to misrepresent official imagery or photography.
  • AI-created representations of official Miss Gay America crowns, logos, or symbols.

Minor editing intended solely for standard photographic correction (including exposure, color balancing, blemish removal, cropping, sharpening, and print optimization) remains acceptable provided the integrity of the original photograph is maintained.

Any advertisement determined to contain excessive AI-generated or AI-altered visual elements may be rejected or returned for revision at the discretion of the Official Program Design Team.


2. Official Crown Usage Standards

The Miss Gay America crown is the premier symbol of excellence within the organization and shall always be displayed respectfully and consistently.

The following standards apply whenever the official crown appears in advertising:

  • The official crown shall appear naturally positioned on the head of the official titleholder.
  • No hand, arm, microphone, bouquet, prop, clothing, graphic element, or other object shall obstruct the Symbol of Excellence.
  • Text, typography, logos, or graphic overlays shall never be placed over any portion of the crown.
  • Hair, bangs, hats, veils, decorative pieces, or other elements may cover no more than the bottom one-quarter (Âŧ) to one-third (⅓) of the crown.
  • No hair or decorative element shall extend upward beyond that point or otherwise obscure the Symbol of Excellence.
  • Images that materially hide, recreate, distort, or replace the official crown may be rejected.

3. Titleholder Image Integrity

Official photographs shall accurately represent each titleholder.

Accordingly:

  • Garment colors of National Titleholders shall not be digitally changed.
  • Official wardrobe shall not be substantially altered through artificial intelligence or digital manipulation.
  • Facial features, body proportions, official jewelry, crowns, sashes, or official regalia shall not be materially altered.
  • Composite images that create inaccurate representations of official titleholders are prohibited.

Reasonable retouching for print production is permitted.


4. Photography Ownership and Usage Rights

Unless otherwise agreed in writing:

  • The original photographer retains all copyrights to the photographs they create.
  • Distribution rights remain exclusively with:
    • the original photographer;
    • the photographed subject; and
    • Miss Gay AmericaÂŽ, acting through the MGA Store for Official Program production and distribution.

Submission of advertising constitutes representation that the submitting party possesses all necessary permissions, licenses, and authorizations required for publication.

The Official Program assumes no responsibility for unauthorized use of copyrighted photography.


5. Intellectual Property

The following are proprietary intellectual property of 2 Queens and a Princess Productions:

  • Symbol of Excellence
  • Miss Gay America affiliated logos
  • Official emblems
  • Official marks
  • Associated branding elements

These intellectual properties may not be recreated, altered, redrawn, traced, generated using artificial intelligence, or otherwise modified without written authorization.

Unauthorized use may constitute trademark and copyright infringement.


6. Design Standards

Advertisements published within the Official Program shall meet the minimum visual design standards established by Miss Gay America Pageantry.

The Program Design Team reserves the right to request revisions when advertisements:

  • appear inconsistent with the quality of the publication;
  • contain excessive AI-generated visual content;
  • contain distorted or manipulated imagery;
  • contain offensive or inappropriate content;
  • violate copyright or trademark protections;
  • contain low-resolution graphics unsuitable for professional printing;
  • fail to meet established production specifications.

Failure to submit acceptable replacement artwork by the requested deadline may result in exclusion from publication without liability to Miss Gay AmericaÂŽ, Deejers Design, 2 Queens and a Princess Productions, or the MGA Store.


7. Photography Standards

Photographs of National Titleholders, contestants, entertainers, vendors, and advertisers should be captured by a human photographer utilizing professional photographic practices whenever reasonably possible.

Professional-quality photography is strongly encouraged for all advertisements submitted for publication.

Images of non-titleholder subjects included in advertising are likewise subject to these standards regarding authenticity, image manipulation, and AI-generated content.


8. AI Content Review

The Official Program Design Team may utilize commercially available artificial intelligence detection technologies during the review process.

Advertisers are encouraged to review their own materials prior to submission using available AI content detection services.

Use of these or similar services does not guarantee acceptance, and final determination regarding compliance rests solely with the Official Program Design Team.


9. Advertising Submission Deadlines

Unless otherwise announced:

  • Print advertising submissions must be received no later than December 15 preceding the National Competition.
  • Digital advertising submissions may be accepted up to seven (7) calendar days prior to the commencement of the National Competition, subject to available production schedules.

Late submissions cannot be guaranteed publication.


10. Official Program Production

The MGA Store serves as the official tracking, bookkeeping, and administrative entity for the production of the Miss Gay America Official Program.

The Official Program is produced through a collaborative partnership between:

  • Deejers Design;
  • 2 Queens and a Princess Productions, Producer of Miss Gay America Pageantry; and
  • Official Miss Gay America franchises, including but not limited to KC Sunshine Entertainment.

Program administration, advertising management, billing, and production coordination may be conducted through the MGA Store on behalf of the participating organizations.


11. Copyright, Trademark, and Permission

Submission of advertising constitutes the submitting party's representation and warranty that:

  • all photographs are used with permission;
  • all graphics are properly licensed or owned;
  • all trademarks are authorized for use;
  • all copyrights are respected;
  • publication will not infringe upon the intellectual property rights of any third party;
  • all models, photographers, designers, artists, and rights holders have granted appropriate authorization where required.

The submitting party agrees to indemnify and hold harmless Miss Gay AmericaÂŽ, 2 Queens and a Princess Productions, Deejers Design, KC Sunshine Entertainment, the MGA Store, their officers, directors, employees, contractors, affiliates, and representatives from any claims arising from submitted advertising materials.


12. Right of Refusal

Miss Gay AmericaÂŽ, 2 Queens and a Princess Productions, Deejers Design, and the Official Program Design Team reserve the absolute right to reject, refuse, remove, request revision of, or decline publication of any advertisement that, in their sole judgment:

  • fails to meet publication standards;
  • diminishes the integrity of the Miss Gay America brand;
  • contains offensive material;
  • contains misleading or deceptive content;
  • excessively relies upon artificial intelligence-generated imagery;
  • infringes upon intellectual property rights; or
  • otherwise conflicts with the mission, values, and image of Miss Gay America Pageantry.

Submission of advertising does not guarantee publication.


Acceptance of Terms

Payment for advertising and submission of artwork shall constitute full acceptance of these Official Program Advertising Standards and Terms and Conditions. The responsibility for verifying ownership, licensing, permissions, copyright compliance, trademark authorization, and adherence to these standards rests solely with the submitting party prior to payment and submission of advertising materials.
