LIMITED REPLACEMENT WARRANTY POLICY
Limited Replacement Warranty
The Miss Gay America Store ("Store") offers an optional Limited Replacement Warranty ("Warranty") designed to provide peace of mind for qualifying bags and similar accessories purchased through our Store.
This Warranty is optional and must be purchased at the same time as the covered product unless otherwise expressly stated by the Store.
Warranty Coverage
Customers may purchase one (1) of the following warranty options for eligible products having an original purchase price of $100.00 or less:

The Warranty provides one (1) replacement claim during the applicable coverage period.
Once a replacement has been issued, the Warranty is considered fully used and terminates.
Covered Failures
This Warranty covers accidental failure of any of the following components caused during normal intended use:
- Broken carrying strap
- Broken shoulder strap attachment
- Broken snap closure
- Broken zipper
- Zipper separation
- Zipper pull failure
- Hardware failure preventing normal use
Coverage applies only when the failure renders the product unusable for its intended purpose.
Maximum Benefit
The maximum benefit under this Warranty is limited to the original purchase price of the covered product, not to exceed One Hundred Dollars ($100.00).
The Warranty does not provide cash refunds.
Replacement Process
If a covered claim is approved, the Store may, at its sole discretion:
- replace the original item;
- replace it with a substantially similar item;
- replace it with an item of equal value; or
- issue Store Credit equal to the original purchase price.
Store Credit
If the original product is discontinued, unavailable, or permanently out of stock, the Store may issue Store Credit in the amount originally paid for the covered item.
Store Credit:
- may be used toward any merchandise offered by the Store;
- is valid for 365 days from issuance;
- is non-transferable;
- has no cash value unless required by law.
Replacement merchandise selected with Store Credit does not inherit the Warranty from the original item.
Any available warranty for the replacement product must be purchased separately.
Custom Products
Custom-produced, made-to-order, personalized, or specially manufactured items are eligible for Warranty coverage under the same terms and limitations contained herein.
Exclusions
This Warranty does not cover:
- Normal wear and tear
- Cosmetic damage
- Scratches
- Stains
- Dirt
- Discoloration
- Abrasions
- Scuffs
- Fabric fading
- Loose threads
- Peeling finishes
- Water damage
- Fire damage
- Smoke damage
- Mold
- Mildew
- Theft
- Loss
- Misuse
- Abuse
- Intentional damage
- Alterations
- Improper cleaning
- Improper storage
- Commercial use beyond intended purposes
- Damage occurring during shipping by parties other than the Store
- Acts of God including floods, tornadoes, earthquakes, hurricanes, lightning, or similar events.
Warranty Claim Procedure
To submit a Warranty claim, customers must:
- Complete the official Warranty Claim Form in its entirety.
- Submit photographs clearly showing the damage.
- Provide proof of purchase.
- Provide any additional documentation reasonably requested by the Store.
Incomplete claims may delay processing.
Claim Review
All claims are subject to review.
The Store reserves the right to:
- inspect submitted photographs;
- request additional documentation;
- request return of the damaged product;
- deny claims that do not meet Warranty requirements.
Claims are typically reviewed within 15 business days after receipt of a complete Warranty claim package.
Submission of a claim does not guarantee approval.
Non-Cancellable Warranty
Once purchased, this Warranty:
- is non-refundable;
- cannot be cancelled;
- cannot be transferred to another customer;
- cannot be transferred to another product.
One-Time Use
This Warranty provides one replacement only during the coverage period.
After a replacement or Store Credit has been issued, the Warranty immediately expires.
Term of Coverage
Coverage begins on the documented delivery date of the covered product.
Coverage automatically expires:
- one (1) year after delivery for the One-Year Warranty; or
- two (2) years after delivery for the Two-Year Warranty,
unless exhausted earlier by an approved replacement claim.
Limitation of Liability
To the fullest extent permitted by applicable law, the Store's total liability under this Warranty shall not exceed the original purchase price of the covered product.
Under no circumstances shall the Store be liable for:
- incidental damages;
- consequential damages;
- indirect damages;
- lost profits;
- loss of use;
- emotional distress;
- personal injury;
- damage to other property,
except where prohibited by applicable law.
Some states do not allow limitations on incidental or consequential damages, so these limitations may not apply to every purchaser.
Consumer Rights
This Warranty gives purchasers specific legal rights.
Purchasers may also have additional rights that vary by state.
Nothing contained in this Warranty limits or waives any consumer rights that cannot legally be waived under applicable federal or state law.
Governing Law
This Warranty shall be governed by the laws of the State of Missouri unless mandatory consumer protection laws of the purchaser's state of residence require otherwise.
For purchasers residing in Georgia, any rights provided under applicable Georgia consumer protection laws shall remain unaffected.
Compliance with Federal Law
This Warranty is intended to comply with applicable provisions of:
- The Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301â2312), where applicable;
- The Federal Trade Commission Act, prohibiting unfair or deceptive trade practices;
- Applicable Missouri consumer protection laws, including the Missouri Merchandising Practices Act (Mo. Rev. Stat. Chapter 407);
- Applicable Georgia consumer protection laws, including the Georgia Fair Business Practices Act (O.C.G.A. § 10-1-390 et seq.).
If any provision of this Warranty is found unenforceable, the remaining provisions shall remain in full force and effect.
Additional Terms and Protective Provisions
Original Purchaser Requirement
This Warranty is valid only for the original purchaser of the covered product and is not transferable. Proof of purchase issued by the Miss Gay America Store is required for every Warranty claim.
Products acquired through resale, auction sites, third-party marketplaces, gifts without proof of purchase, or unauthorized sellers are not eligible unless otherwise approved in writing by the Store.
Fraud Prevention
The Store reserves the right to deny any Warranty claim that is believed, in its reasonable judgment, to involve:
- Fraud
- Misrepresentation
- Altered documentation
- False statements
- Fabricated damage
- Intentionally caused damage
- Submission of photographs that do not accurately represent the claimed product
- Multiple claims for the same item
- Attempts to obtain replacement products through deceptive means
Any fraudulent claim may result in:
- Immediate denial of the claim;
- Cancellation of any remaining Warranty benefits;
- Refusal of future Warranty purchases;
- Cancellation of future orders, where permitted by law; and
- Referral to law enforcement or other legal remedies if appropriate.
Inspection of Product
The Store reserves the right to require the customer to return the damaged product before approving a replacement.
Return shipping instructions will be provided if required.
Failure to return the product within the requested timeframe may result in claim denial.
Products approved for replacement become the property of the Store unless otherwise stated.
Photographic Evidence
Customers must submit clear photographs that accurately depict:
- The entire product;
- The damaged area;
- Any identifying labels or tags, if present.
The Store may request additional photographs or videos if necessary to evaluate the claim.
Replacement Item Availability
Replacement items are subject to inventory availability.
The Store reserves the right to substitute a comparable product of similar style, color, or function if an exact replacement is unavailable.
Comparable products shall be determined at the Store's reasonable discretion.
No Cash Value
This Warranty has no cash surrender value.
Approved claims will not result in cash payments except where required by applicable law.
Non-Renewable Coverage
Each Warranty applies solely to the originally covered product.
Replacement products, products purchased using Store Credit, or substitute products are not automatically covered under this Warranty.
If eligible, a new Warranty may be purchased for replacement merchandise at the time of replacement or new purchase.
Abuse of Warranty Program
The Store reserves the right to refuse future Warranty purchases or claims from customers who demonstrate a pattern of excessive claims, abusive conduct, fraudulent activity, or repeated misuse of the Warranty program.
Nothing in this section limits any consumer rights that cannot legally be waived.
Product Modifications
This Warranty becomes void if the covered product has been:
- Modified;
- Repaired by unauthorized persons;
- Altered;
- Customized after purchase in a manner affecting the covered components;
- Used contrary to its intended purpose.
Routine personalization performed or authorized by the Store does not void this Warranty.
Shipping Damage
Damage occurring during shipment from the Store must be reported separately under the Store's Shipping Damage Policy and is not considered a Warranty claim.
Damage occurring during customer-arranged shipping after delivery is not covered unless otherwise required by law.
Limitation on Multiple Recoveries
Customers may not recover benefits for the same product under multiple programs.
If compensation has already been received through:
- Shipping insurance;
- Credit card purchase protection;
- Third-party insurance;
- Another warranty provider; or
- Any other reimbursement source,
the Store reserves the right to reduce or deny Warranty benefits to prevent duplicate recovery.
Electronic Agreement
By purchasing this Warranty, the customer acknowledges that they have:
- Read this Warranty in its entirety;
- Had the opportunity to review all terms before purchase;
- Agreed to all conditions;
- Accepted electronic delivery of this Warranty.
Electronic acceptance constitutes a legally binding agreement to these terms under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state laws governing electronic transactions.
Governing Law and Venue
This Warranty shall be governed by the laws of the State of Missouri, without regard to conflict of law principles, except where mandatory consumer protection laws of the purchaser's state of residence apply.
Unless otherwise prohibited by law, any legal action arising from this Warranty shall be brought exclusively in the state or federal courts located in Missouri. Each party consents to the personal jurisdiction and venue of those courts.
Arbitration (Optional)
This section should only be included after consultation with legal counsel. Arbitration clauses and class action waivers must be drafted carefully to maximize enforceability.
Except where prohibited by law, any dispute arising from this Warranty shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment upon the arbitration award may be entered in any court having jurisdiction.
Nothing in this section limits a customer's right to bring an individual claim in small claims court where permitted.
Class Action Waiver (Optional)
To the fullest extent permitted by law, all disputes shall be resolved only on an individual basis. Customers waive any right to participate as a plaintiff or class member in any purported class, collective, representative, or consolidated proceeding.
If a court determines this waiver is unenforceable, only this section shall be severed, and the remaining provisions of the Warranty shall remain in effect.
Severability
If any provision of this Warranty is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
Force Majeure
The Store shall not be liable for any delay or failure to perform its obligations under this Warranty due to events beyond its reasonable control, including but not limited to natural disasters, acts of God, war, terrorism, labor disputes, governmental actions, supply chain disruptions, pandemics, transportation interruptions, cyberattacks, or other events beyond the Store's reasonable control.
Reservation of Rights
The Store reserves the right to amend, discontinue, or modify this Warranty program for future purchases at any time. Any modifications shall not reduce or impair coverage already purchased before the effective date of the change, unless required by law.

Entire Agreement
This Limited Replacement Warranty constitutes the complete agreement regarding Warranty coverage and supersedes any prior oral or written representations concerning the Warranty.
